Terms of Service

These Terms of Service (“Terms”) govern your use of Gather Tickets. By creating an account, listing an event, or purchasing a ticket, you agree to these Terms. If you do not agree, please do not use the service.
1. Who we are and acceptance
Gather Tickets is operated by MGC Systems Ltd, a private limited company incorporated in England and Wales, with registered address at [TBD: registered address] (company number 15552651) (“we”, “us”, “our”).
By using the Gather Tickets website or any of its features, you confirm that you accept these Terms and our Privacy Policy.
2. Definitions
- Buyer: a person who purchases or registers for a ticket through Gather Tickets.
- Organiser: a person or entity that lists an Event on Gather Tickets and sells tickets to it.
- Event: the activity (concert, gathering, workshop, etc.) listed by an Organiser on Gather Tickets.
- Ticket:a digital licence to attend an Event, issued under these Terms and the Organiser’s own terms.
- Platform Fee:the fee we charge for use of Gather Tickets, displayed at checkout. Stripe’s payment processing fees are charged separately.
3. Eligibility
You must be at least 16 years old to use Gather Tickets as a Buyer. To list events as an Organiser you must be at least 18 and have the legal capacity to enter into a contract on behalf of yourself or the entity you represent.
4. Account and security
You are responsible for keeping your account credentials secure and for all activity carried out under your account. We use Supabase to manage authentication and store account data securely. Tell us immediately at support@gathertickets.co.uk if you suspect unauthorised use of your account.
5. Buyer terms
When you purchase or register for a Ticket, you enter into a contract with the Organiser of the Event. Gather Tickets acts as the Organiser’s agent for the purpose of taking payment and delivering the Ticket; we are not the supplier of the Event itself, and the Organiser is responsible for delivering the Event as described in the listing.
Tickets are personal, non-transferable digital licences to attend the Event. The Organiser may set additional terms (for example, age restrictions or door policies); those are part of your contract with the Organiser.
We may invalidate Tickets where there is evidence of payment fraud, including chargebacks raised after the Event without good cause.
6. Refunds and cancellations
The Organiser sets and is responsible for the refund policy for their Event. The Organiser must display that policy on the Event listing or otherwise make it available before purchase.
Most Events on Gather Tickets are for the supply of leisure services for a specified date or period of performance. Under regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, contracts for those Events are exempt from the standard 14-day cancellation right. This means you do not have an automatic right to a refund simply because you change your mind; refunds are governed by the Organiser’s policy.
Where the Organiser authorises a refund, Gather Tickets will process it through Stripe to the original payment method. Where the Organiser cancels an Event, the Organiser is responsible for issuing refunds; we will assist with processing them through the platform on the Organiser’s instruction.
Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015 — for example, where an Event is not as described, or is not performed with reasonable care and skill.
7. Organiser terms
If you list Events on Gather Tickets, you additionally agree to the following:
- You will only list lawful Events and will not use Gather Tickets for any prohibited content or conduct (see Section 9).
- You will comply with Stripe’s Connected Account Agreement and any KYC requirements imposed by Stripe.
- You will hold all permissions, licences, and insurance required to run your Event.
- You will set a clear refund policy and display it on the Event listing.
- You will deliver the Event substantially as described in the listing.
- You accept our Data Processing Addendum with respect to attendee personal data we process on your instruction.
- You will indemnify us against any claim arising from your Event or your breach of these Terms, except to the extent caused by our negligence or wilful misconduct.
8. Fees
The Platform Fee and Stripe’s payment processing fees are shown at checkout before the Buyer confirms the purchase. Organisers receive the remainder of the ticket price via Stripe Connect payouts on Stripe’s standard schedule. We may change the Platform Fee from time to time; changes apply only to Events listed after the change takes effect.
9. Prohibited content and conduct
You may not use Gather Tickets to:
- list or sell tickets to anything illegal under English law
- promote hatred or violence against any group, including on the basis of a protected characteristic under the Equality Act 2010
- commit fraud or facilitate money laundering
- infringe anyone else’s intellectual property rights
- send spam or unsolicited bulk email
- scrape, crawl, or access the service through automated means other than published APIs we make available
- attempt to bypass technical or contractual access controls
10. Suspension and termination
We may suspend or terminate your account, remove Events, or withhold payouts if we reasonably believe you are in material breach of these Terms or of any rule applied to us by Stripe. Where it is reasonable to do so, we will give you notice and a chance to remedy the breach. We may act without notice where the breach is serious, ongoing, or where we are required to act immediately by law or by Stripe.
You may close your account at any time by contacting support@gathertickets.co.uk.
11. Liability
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- any other liability that cannot be lawfully limited or excluded under English law (including, where applicable, certain rights under the Consumer Rights Act 2015)
Subject to the above, our total aggregate liability to you arising from or in connection with these Terms or your use of Gather Tickets is limited to the greater of (a) the fees you have paid to us in the 12 months immediately before the claim arose and (b) £100.
We are not liable for the conduct of Organisers or Buyers, the quality, safety, or legality of any Event, or any loss arising from cancelled or rescheduled Events. Refunds in those situations are governed by Section 6.
We are not liable for indirect or consequential loss, loss of profits, loss of data, or loss of goodwill, except to the extent such loss cannot be lawfully excluded.
12. Intellectual property
You keep ownership of the content you submit to Gather Tickets (Event titles, descriptions, images, etc.). By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, publish, and display that content for the purpose of operating the service and promoting your Event. This licence ends when you remove the content, except to the extent we need to retain copies for legal, regulatory, or backup purposes.
13. Changes to these Terms
We may update these Terms from time to time. For material changes, we will notify you by email or via a notice on the site at least 14 days before the change takes effect. Continuing to use Gather Tickets after a change means you accept the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising under or in connection with these Terms, except that if you are a consumer resident in another part of the United Kingdom you may also bring proceedings in your local courts as permitted by law.
